These Terms set out the conditions under which LAREN MN EOOD sells goods through the online store available at larencosmetics.com, hereinafter referred to as the STORE.

Any person visiting or using the website is referred to below as a USER.

By using the STORE, including by placing or paying for an order, the USER agrees to comply with these Terms and Conditions.

The STORE may process technical information relating to the use of the website, including IP addresses and information stored in server log files, under the conditions and for the purposes described in the applicable Privacy Policy.

The STORE reserves the right to change displayed prices at any time. The customer pays the price that was current and confirmed at the time the order was placed.

The STORE takes reasonable care to ensure that information concerning the products offered is accurate. Some information may be supplied by manufacturers, suppliers or other official sources. The STORE is not liable for inaccuracies which it could not reasonably have identified, except where such liability may not be limited under applicable law.

Rights and responsibilities of the parties

Products offered in the STORE are presented subject to the conditions stated on their respective product pages.

The STORE may amend the published products, availability and prices, with such changes taking effect upon publication on larencosmetics.com.

Price changes do not affect orders already confirmed, except in the event of an obvious technical error, in which case the customer will be informed without undue delay.

Limitation of liability and personal data

For the purchase and delivery of products, the USER provides personal data necessary for processing and fulfilling the order.

Personal data is processed in accordance with applicable data protection legislation and the Privacy Policy of larencosmetics.com.

The information provided is used for purposes related to fulfilling the order, customer service, compliance with legal obligations and other purposes described in detail in the Privacy Policy.

Where necessary for fulfilling an order or complying with a legal obligation, personal data may be disclosed to relevant service providers, such as courier, payment, accounting or technical service providers, in accordance with applicable legislation.

Changes to product prices

The STORE may change prices at any time without prior notice to users.

The USER pays the price that was current and confirmed at the time the order was placed.

Reduced prices are displayed in accordance with applicable legal requirements.

In the event of an obvious technical error concerning a price, product information or other material information, the STORE may refuse or cancel the affected order after informing the USER.

If amounts have already been paid in respect of such an order, they will be refunded.

Rights and obligations under consumer protection legislation

The information required under applicable consumer protection legislation includes the following:

  1. The main characteristics of each product are described on its respective product page.

  2. The final price of each product is displayed on its product page.

  3. The online STORE does not charge additional costs for the use of a means of communication for concluding the contract other than the normal cost of the communication service used by the USER, where applicable.

  4. Payment, delivery and performance conditions are displayed on the website and/or during the ordering process.

  5. Right of withdrawal

Where provided for by law, the USER has the right to withdraw from a distance contract without giving any reason within 14 days.

The period begins on the date on which the USER, or a third party nominated by the USER other than the carrier, receives the goods.

Where several goods ordered together are delivered separately, the period begins when the final item is received.

Where goods consist of several parts or lots, the period begins when the final part or lot is received.

To exercise the right of withdrawal, the USER must inform the STORE of their decision through an unequivocal statement sent using the stated contact details.

The USER may use a standard withdrawal form or submit another unequivocal statement.

To meet the deadline, it is sufficient for the notice exercising the right of withdrawal to be sent before the 14-day period expires.

Where the right of withdrawal has been validly exercised, the STORE reimburses payments received in accordance with applicable law, including standard delivery charges where required by law.

Where the USER selected a delivery method other than the least expensive standard delivery option offered by the STORE, additional costs are not reimbursed to the extent permitted by law.

The STORE may withhold reimbursement until it receives the goods back or until evidence is provided that the goods have been sent back, whichever occurs first and to the extent permitted by law.

The USER must send or hand the goods back without undue delay and no later than 14 days after notifying the STORE of the withdrawal.

The deadline is met if the goods are sent before the 14-day period has expired.

The USER is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.

Where applicable, returned goods should include the relevant parts, accessories and accompanying documentation.

Exceptions to the right of withdrawal apply where provided for by applicable law.

   6. When exercising the right of withdrawal, the USER bears the direct cost of returning the goods unless the STORE states otherwise or applicable law provides otherwise.

   7. Non-conforming goods and complaints

Upon receiving a parcel, the USER may inspect its contents and the visible condition of the products.

Where the goods received do not correspond to the goods ordered, the STORE will take the measures required under applicable law to bring performance into conformity without unjustified cost to the USER.

Where an item is missing, the STORE may offer a suitable replacement, which the USER is free to accept or reject. If the replacement is rejected, the corresponding amount paid will be refunded.

Where a product is defective or otherwise non-conforming, the USER has the rights provided by applicable consumer protection legislation.

In the event of visible transport damage, the USER is advised to request an appropriate damage report from the courier where possible.

If a dispute cannot be resolved amicably, the USER may contact the Bulgarian Consumer Protection Commission and/or another competent authority or applicable alternative consumer dispute resolution body.

The STORE may amend these Terms and Conditions. Amendments will be published on larencosmetics.com and will not affect contracts already concluded unless otherwise required by applicable law.

Orders

Each order submitted through the website constitutes an offer by the customer to enter into a sales contract.

After an order is received and confirmed, the STORE sends an electronic confirmation using the contact details provided by the USER.

Orders may be placed using the methods available on larencosmetics.com, including by adding products to the shopping cart and completing the ordering process.

Where the website permits orders with or without registration, the selected method of ordering does not in itself alter the applicable delivery and performance conditions.

Information concerning delivery terms and periods is available in the relevant section of the website.

Delivery and return conditions

Delivery is carried out using the available methods stated on larencosmetics.com, including delivery to a courier office or to an address specified by the customer where such options are available.

Upon delivery, the USER may inspect the contents of the parcel and the visible condition of the products.

Conditions for returning goods

Upon receiving a parcel, the USER may inspect the goods and verify that they correspond to the order.

Where goods received do not correspond to those ordered, the STORE will take appropriate action in accordance with applicable law.

Where an item is missing, the STORE may offer an alternative product. The USER is not required to accept the replacement, and if it is rejected the corresponding amount paid will be refunded.

If there is a problem with a purchased product, the USER may contact a representative of the STORE using the contact details provided on the website.

Where a product is defective or non-conforming, the USER has the statutory rights provided by applicable law, and any costs which by law must be borne by the seller will be borne by the STORE.

WITHDRAWAL FROM AN ORDER

Where entitled to do so under applicable law, the USER has the right to withdraw from a contract for the purchase of goods within 14 days after receiving the goods.

The USER must communicate the decision to withdraw through an unequivocal statement addressed to the STORE, for example:

  • through the website contact form, where available;

  • by sending the standard withdrawal form or another written statement by email;

  • through another durable means of communication provided by the STORE.

The USER must return the purchased goods to the return address specified by the STORE without undue delay and no later than 14 days after notifying the STORE of the withdrawal.

The direct costs of returning the goods are borne by the USER unless the STORE states otherwise or applicable law provides otherwise.

The right of withdrawal does not apply in cases expressly excluded by law, including where the statutory requirements are met for goods which, for health protection or hygiene reasons, are not suitable for return after they have been unsealed.

TERMINATION

These Terms and the relationship between the USER and the STORE may be terminated in the following circumstances:

  • termination, liquidation or insolvency of a party, where applicable;

  • mutual agreement between the parties;

  • objective impossibility of performance;

  • other circumstances provided for by law.

Where a user account on the website is deleted or terminated, contracts already concluded but not yet performed remain in force unless terminated on another lawful ground.

The STORE may restrict or terminate a USER's access to the website if it establishes that the website is being used in breach of applicable law, these Terms and Conditions or the rights and legitimate interests of other persons, provided that this does not affect mandatory rights already acquired by the USER.

LIABILITY

Each party is liable for damage caused by it in accordance with applicable law.

The USER is liable for breaches of these Terms and Conditions or third-party rights where the legal requirements for such liability are met.

The STORE is not liable for failure to perform caused by force majeure, unforeseen events, significant technical failures, internet interruptions or actions of competent public authorities where such circumstances are outside its reasonable control.

The STORE is not liable for damage caused by the USER to third parties.

The STORE does not guarantee uninterrupted availability of the website during technical maintenance, force majeure or other objective circumstances outside its reasonable control.

Where the website allows comments, reviews or other user-generated content, the author of that content is responsible for it in accordance with applicable law. This does not exclude any obligations imposed on the STORE by applicable law.

The STORE is not liable for consequences arising from unlawful circumvention of security measures by third parties unless the damage results from the STORE's failure to comply with a legal obligation.

The STORE is not liable for actions resulting from a third party unlawfully impersonating a USER where the STORE has exercised the level of care required by law and the circumstances.

Nothing in these Terms excludes or limits liability of the STORE or rights of the USER that cannot lawfully be excluded or limited.

OTHER CONDITIONS

The USER and the STORE undertake to respect each other's rights and legitimate interests.

The parties must protect information constituting legally protected trade secrets, personal information or other confidential information where they are legally required to do so.

Nothing in these Terms restricts a party's right to use or disclose correspondence where this is necessary to exercise or defend legal rights, submit a complaint, seek protection before a competent authority or court, or where disclosure is permitted or required by law.

Where these Terms conflict with individually agreed specific terms between the STORE and the USER, the individually agreed terms will prevail insofar as they are lawful and do not restrict mandatory consumer rights.

The invalidity or unenforceability of an individual provision of these Terms does not affect the validity of the remaining provisions.

Any matters not expressly regulated by these Terms in relation to their performance and interpretation and contracts concluded through the STORE are governed by the laws of the Republic of Bulgaria and applicable European Union law.

The choice of Bulgarian law does not deprive consumers of mandatory protection available to them under applicable consumer protection legislation.
